German law is very strict. As customer, you have legal rights. These right have been violated: you did not get what you paid for, was advertized and was promised upfront.
I think they overestimated the complexity of their goals versus their knowledge and expertise. They were doing great in the beginning, but more complexity came with the new design. Nothing wrong with that. But when loyal customers, who urged the company to finally fix the obvious recurring problems, these problems went unaddressed. Instead, customers were: ignored, accused of backbiting, accused of being malicious, of being difficult, or of being unreasonable for what the product offers in terms of functionality. It is a shame to see that they have not overcome this, both technically, emotionally and psychologically. However, my hope for improvement, recovery and change is gone. This is not going to get better. And that is a shame for all those customers who have paid their hard earned money up front via kickstarter to have a product developed that will never work as advertised. Sad to conclude this, but I think it is the core of truth.
Don't get me wrong here: I love the people behind this project. I have no bad feelings towards them. They have done their best, were on the cutting edge of developing new products and came pretty far, but I must also look at the customer picture here: Customers did support them all the way, for a long time, invested a lot of money in them and also a lot of spare time. All of this did not bring about the change that is needed to change course in such a way that prelonged problems were brought to a customer satifactory solution (example: battery draining is a huge problem, even when the camera is OFF for a while!). The diehard, first time users, have all rang the bell often enough so that the company could do something about it. It never came to that realisation. That is why many diehard fans from the very beginning are now dropping out and abandoning the project for good. Sad but true. A class action suit is possible, but do you want to waste all your time and energy getting your money back? By the time you have your money back, you have become 75 years and you have lot of piled up frustrations! I can tell you from the bottom of my heart: that ain't worth it! Forgive, forget and move forward! Life is too short to waste your time, money and effort on "getting your money back" because you have legal rights. We all have legal rights and these are being violated day-to-day! Forgive quickly, for you do not want to pay the price with your soul! It ain't worth it!
Read Matthew 18:21-35 King James Bible. Don't end up in that situation! For you pay a higher price than the money you lost now. Losing your soul, your peace of mind, and ending up in a pile of frustation emotionally, is a price too high to pay! Get out now!

The bigger shame is that this kind of behaviour leads to a general lack of trust in startups and investment where trust and communication are essential.
That weve heard nothing from Charles and he is obviously continuing to sell this unworkable device leaves one with the only conclusion available: its a good idea, poorly implemented that has become a snatch and grab. IOW: (dare I say it?) a scam.

A good implementation can get corrupted and the product can degrade into a lesser good product over time. Next to that, brand names can alter their firmware implementations so that the firmware of the Foolography product starts to fail over time. Wanting to support all brand names of digital cameras can only be accomplished when all have been tested before going from beta to production phase. I think too much was promised upfront and less was actually accomplished afterwards, seeing the drama happen before your eyes that you have awaiting customers who have paid upfront 750k euros and are desperately waiting to get their ordered product, but the technical implementation is lacking sound design and implementation details. Not to mention the hardware that must be produced correctly (look at the cable finishing, that says enough: poor quality). This project is a dream ending in a nightmare.
Don't feed your anger. Starve it out, before it starts eating your soul away, bit by bit. I have seen it happen. Those people are now in full time bondage by anger, taken captive by the Devil. For real! I am not joking!
